Built To Optimize (“Built To Optimize,” “we,” “us,” or “our”) values your privacy and is committed to protecting it. This Privacy Policy & Terms of Service (“Policy”) explains how we collect, use, store, and disclose information, and governs your use of our website, services, communications, and marketing offerings.

By accessing this website, submitting any form, onboarding as a client, making payment, or otherwise engaging with Built To Optimize, you acknowledge, understand, and agree to be legally bound by this Policy.

If you do not agree, do not use this website or our Services.

1. SERVICES & ACCEPTANCE OF TERMS

Built To Optimize provides digital marketing and advertising services, including but not limited to Google Ads management, YouTube Ads management, strategy, consulting, and related services (“Services”).

This Policy applies to:

  • Website visitors

  • Leads and prospects

  • Clients and former clients

  • SMS subscribers

These terms are incorporated by reference into all proposals, onboarding forms, invoices, and communications.

2. PAYMENT TERMS & BILLING POLICY

Prepayment Required

All Services are billed in advance. Payment must be received prior to the commencement of work for any billing period.

Advertising Spend Responsibility

Advertising platform charges (including Google Ads, YouTube Ads, or other third-party platforms) are billed directly to the Client’s own credit card or payment method, not through Built To Optimize.

You acknowledge and agree that:

  • You are solely responsible for maintaining a valid, active payment method with sufficient available credit

  • Built To Optimize does not control or process ad platform charges

  • Any interruption in advertising due to payment failure, declined cards, or insufficient credit is the Client’s responsibility

Service Suspension

If payment for Services or advertising spend becomes late, fails, or is declined:

  • Services may be immediately paused without notice

  • Built To Optimize is not liable for lost performance, delays, revenue impact, or damages resulting from suspension

3. LATE FEES, COLLECTION & NO REFUNDS

Late Fees

Invoices not paid within 15 days of the due date may incur a late fee of 10% of the outstanding balance, assessed monthly until paid in full, to the maximum extent permitted by law.

Collection Costs

If Built To Optimize is required to pursue collection of unpaid amounts, you agree to pay all reasonable collection costs, including attorneys’ fees, court costs, and pre-litigation expenses.

No Refunds

All sales are final. No refunds are provided for:

  • Services rendered or partially rendered

  • Prepaid Services

  • Service interruptions caused by client non-payment or ad account issues

4. NO GUARANTEES OR WARRANTIES

Built To Optimize does not guarantee specific outcomes, revenue, conversions, cost-per-lead, or performance results. Advertising performance depends on factors outside our control, including platform algorithms, competition, budgets, market conditions, and client responsiveness.

Services are provided “as is” and “as available.”

5. TEXT MESSAGE (SMS) COMMUNICATIONS

Agreement to Receive Text Messages

By providing your mobile number, you agree that Built To Optimize, via SimpleTexting, may send you SMS or MMS messages containing important account information, service updates, notifications, and related communications.

  • Message frequency: up to 4 messages per month

  • Message and data rates may apply

  • United States participating carriers include AT&T, T-Mobile®, Verizon Wireless, Sprint, Boost, U.S. Cellular®, MetroPCS®, and others

  • T-Mobile is not liable for delayed or undelivered messages

Opt-Out & Help

  • Text HELP to (206) 424-7918 for assistance

  • You may receive a confirmation message upon opting out

You agree to notify us of any changes to your mobile number and to update your account accordingly.

SimpleTexting may modify or terminate SMS services at any time, with or without notice.

6. INFORMATION WE COLLECT

Personal & Activity Data

We may collect:

  • Name, email address, phone number, business information

  • Browser type, operating system, IP address

  • Website usage and interaction data

13. GOVERNING LAW & JURISDICTION

This Policy shall be governed by and construed under the laws of the State of New Jersey, without regard to conflict-of-law principles.

You consent to exclusive jurisdiction and venue in state and federal courts located in New Jersey.
